General travel conditions
These contract conditions are an integral part of the contract between you and the Carpe Diem Luxury Apartments, Family Promberger.
1. Booking, contractual relationships, costs and payment conditions You can make a booking by telephone, in writing or online. You will receive a written confirmation of booking. The apartment guest should pay 30% of the rental fee by bank transfer within 14 days of receipt of the booking confirmation. The contract between you and the Family Promberger, Luxury Apartments Carpe Diem is binding after receipt of the deposit. The remainder of payment should be paid in resort in cash. If a deposit is not paid within 14 days then the booking becomes null and void. In the case of bookings made less than 14 days before arrival, the whole rental fee should be paid straightaway, so that the sum is paid into the bank account of Family Promberger at least three days before arrival, otherwise the booking becomes null and void.
2. Facilities and prices The prices stated are daily rates for the whole apartment including furniture, normal power consumtion and utility objects. The minimum duration of stay is normally 7 days, arrival and departure day is Saturday unless otherwise agreed. The price information categorically states which facilities are included (e.g. towels, bedlinen) and which not (end of stay cleaning and local taxes). These extra charges will be added to the bill. Special services requested by guests are to be paid in resort (e.g. extra cleaning, extra bedlinen, pets etc.).
3. Changes in facilities and prices The apartment descriptions and prices are written with care. However, it can happen that changes to services and prices are necessary. Should this be the case, we will inform you at the time of booking. Should there be a difference between the homepage and your booking confirmation then the conditions on the booking confirmation apply. Should major changes occur after conclusion of the contract, you can withdraw from the contract free of charge within 5 days of receiving notice. We reserve the right to make price changes up to 22 days before arrival for the following reasons: increase or introduction of taxes on certain services, change in exchange rate after conclusion of contract. Should there be a price increase of more than 10%, you reserve the right to withdraw as stated above.
4. Arrival, departure, curtailling or extending your stay The apartment guest is obliged to advise his time of arrival, which should be between 3 and 7 p.m., departure should be before 11 a.m. Should the guest arrive after 7 p.m. he should inform us in advance (address and telephone number can be found on your booking confirmation). Should you arrive late due to traffic jams or bad weather you will be charged the whole rental fee. The same applies in the event of early departure. If you wish to extend your stay, please let us know as soon as possible.
5. Cancellation by the guest The apartment guest may withdraw from the contract free of charge up to 30 days before arrival. Should this happen the deposit will be refunded straightaway minus an administrative charge of 10% of rental fee. Should the apartment guest cancel after this period the following cancellation charges apply: up to 29 days before arrival = 50% up to 2 days before arrival = 80% . In the event of cancellation 1 day before arrival or on the arrival day itself the apartment guest must pay the whole rental fee. Decisive is the receipt of notice by Family Promberger (in the event of Sundays and public holidays the next working day is decisive). The fees are deducted from the deposit. We recommend you take out Travel Cancellation Insurance.
6. Alternative accommodation and cancellation of contract by Family Promberger, Luxury Apartments Carpe Diem Family Promberger, Luxury Apartments is entitled to cancel the rental contract without notice due to events beyond our control, war, strike, changed circumstances of the owner or other imperative reasons. In this instance rental deposits will be refunded in full.
7. Liability of apartment guest The apartment may only be occupied by the stated number of persons (children and babies included). Additional persons could be turned away or charged extra. The apartment is to be used with care. Neighbours etc. should also be taken into consideration. The apartment owner should be notified immediately of any damages caused by the apartment guest. The guest is liable for any damages caused by him or his party, unless he can prove he was not negligent. The same applies if the apartment cannot be handed over to the next guests.
8. Complaints, compensation for damages, our liability If you have any complaints, please contact us as soon as possible. We should be notified of any faults immediately, complaints made after departure cannot be taken into consideration. We take no responsibility for the apartment guest whilst he is staying in the apartment. We have no insurance for the guest or his property.
9. Court of Jurisdiction Court of Jurisdiction for all legal disputes between guest and apartment owner is 8970 Schladming, Austria. Prices subject to change and all errors and omissions excepted. This legal relationship is solely subject to Austrian law.
